Terms and Conditions for Photographers

Terms and conditions that photographers accept in submitting images are as follows:

I (the photographer) will submit to Photoconnect from time to time images and supporting content that I would like Photoconnect to publish on my behalf on the Photoconnect site. I accept the full terms and conditions of submission as set out on the pages on the site dealing with selling images and the relevant pages on restrictions and model releases.

In exchange for the fee due Photoconnect will publish each block of content on the web for a period of a minimum of one year. (A block of content may be two or five pages depending upon the service requested). The period of one year commences when the first page of the block is submitted to the site. After a period of one year a further fee may then be required should I wish to retain the content on the site. See pricing.

I have read the buyer pages on the Photoconnect site that indicate the standards of service that buyers should expect and will adhere to these standards. In the case of substantiated complaints from customers then I understand that my content may be removed from the Photoconnect site.

In dealing with buyers, I accept that Photoconnect is not my agent and I am solely responsible for delivering a quality image to the satisfaction of the buyer. Similarly I am solely responsible for the collection of funds due.

If I sell an image on this site or elsewhere in a way that affects the availability of an image in a particular licensed form then I will update the information on the site accordingly. If I sell an image under a license then it is my responsibility to monitor the terms of that license.

I warrant that any images that I submit to you are my copyright. I am able to produce model or property releases if relevant should a buyer request these. I will make known to the buyer any restrictions that may for any reason be in place in respect of use of a purchased image.

I am aware that images featured on the web can be taken from web pages without my receiving funds due. I accept this as a hazard of putting my images on the web with a view to achieving sales of high resolution files.

I accept that photoconnect should bear no responsibility should any images so removed from the site be abused. I also accept that photoconnect should bear no responsibility should any images validly sold by myself be similarly abused by the buyer.

I accept that you have no control over the behaviour of the search engines and whether the Photoconnect site, individual pages or images are listed or not.

Note re last paragraph - we tailor the site and individual thumbnail pages carefully to get pages listed prominently at search engines. While excellent results are normally achieved, unfortunately, the nature of the way the engines work is that nothing can ever be guaranteed.

All photographs on this site are the copyright of the photographer. Please be aware that any use without permission will be charged at a minimum at the full market rate applicable to a traditionally licensed image. No volume discounts or other incentives shall be applicable in calculating this rate. Further, if you use without permission you accept that damages will be payable should the value of future or current earnings of an image be adversely affected and you also accept that fair time and other costs of recovering amounts due should be payable.
